Wills
Drafting a will can be the difference between you deciding how you would like your estate to be handled after you die and a court making these decisions for you. Without a Will, not only will your assets be divided and distributed to only the beneficiaries that are designated under California probate law, but if you have underage children and you did not name anyone as their legal guardian in your Will, a judge may decide who gets custody of your children and it may not be the person that you would have actually chosen.

Trusts
One of the advantages of setting up a Trust is that they do not fall under the jurisdiction of a probate court. A Trust is an agreement that places certain assets in a Trust that is managed by a Trustee—either the person who set up the Trust (called the grantor) and/or another person or organization appointed to administer the Trust. Like a Will, a Trust lets you distribute your assets in specified ways to designated beneficiaries whom you have chosen.
